Please read these Terms & Conditions carefully. In these terms and conditions (the “Terms & Conditions”) "we" means: Kyriacos Photography and "us" and "our" will be construed accordingly; and "you" means the customer or potential customer for products (and "your" will be construed accordingly). The Terms & Conditions apply when you place an order at www.kyriacosphotography.com, and all of its related pages (the “web page”). The web page is property of Kyriacos Photography and any names, trademarks, images, design, products, services, and other content can not be copied or used without the written consent of ahabiimagery. These Terms & Conditions are set to apply to all sales through www.kyriacosphotography.com. No waiver or modification of these Terms & Conditions will be binding, unless approved in writing by an authorised representative of Kyriacos Photography.

Service & Sales

We offer printed art via photographs and typography. You can buy prints (the “products”) through the web page. All prints are made on-demand and we hold no stock of prints. You must be minimum 18 years old to order via the web page. We reserve the right to refuse or change your order. A purchase agreement is concluded when we have confirmed your order and you have received an order confirmation from us via e-mail. Orders are entitled to be cancelled or terminated up to the point in time where Kyriacos Photography has sent confirmation of the order. Full refunds will be issued in the event a product order has been cancelled.

About our Products

Kyriacos Photography prints are printed on premium quality Fujicolor Crystal Archive Professional Matte DP II photo paper. Each print are printed via a certified studio.

All prints are made on-demand, therefore we don't hold stock of prints and your print is always custom made for you. Photographs may be cropped slightly to fit print area.

Due to calibration differences between computers and other screens, colours represented on the web page may vary slightly from the actual product.

Print Sizes

Where specified, Ahabi Imagery prints come in 5 sizes as outlined below, measurements are in inches.

• 12 x 8

• 15 x 10

• 18 x 12

• 24 x 16

• 36 x 24

All prints are sent to you in either a cylindrical tube or hard backed envelope to prevent damage during transport.

Margins

• Prints come with a white margins of 2.54cm / 1" (white border) for framing

• Margins do not affect print sizes.

Delivery

We will arrange for the products to be delivered to the address for delivery indicated in your order or to a nearby delivery point. Our unframed fine art prints are hand rolled in protective tissue paper and then shipped in a cardboard tube. We use reasonable endeavours to produce and ship out products within 7 working days of the date of our order confirmation. However, we cannot guarantee delivery by the relevant date. We do however guarantee that unless there are exceptional circumstances all products will be sent out within 21 working days of the later of receipt of payment and the date of our order confirmation. Should product delivery be delayed over 30 working days without causation on the buyers behalf, purchase cancellation is permitted.

We reserve the right to produce any products ordered until payment has been received in full, henceforth restricting delivery of products until adequate payment is processed.

For international deliveries, we are not responsible for local taxes and import duties that may apply.

If any package is to be be picked up at a specific delivery point, a specification for pickup will be indicated and this notification will alert you as to the location and time for product receiving or pickup. Notifications are to be presented by standard text message, electronic mail or a telephone call. The delivery of products which are not claimed will be shipped back to Kyriacos Photography. In such scenarios, buyers will be charged any cost involved with the delivery of the products back to Kyriacos Photography.

Returns

All prints are made on demand, meaning no refunds will be accepted unless the product is considered damaged or defective.

For damaged or defective products, our cancellation period is 14 days. If you wish to cancel a purchase, you shall, prior to the expiry of the cancellation period, send a clear message to us in the manner set forth here.

To initiate a refund, send an e-mail to ahabiimagery@gmail.com accompanied with a visual representation depicting the manner, which the packaging and / or product has experiences deficiencies, defectiveness, or damages. State in the message the order number along with an indication whether you want a financial reimbursement or a product exchange, accompanied with reasoning for the request. The period from which an item can be returned begins when you receive the product.

If under the jurisdiction of our return policy, your refunds will be equal to your financial commitment for the product (s) and delivery, and acted upon immediately with the latest being one month after the return of the goods. The financial obligation to return a product to Kyriacos Photography rests with you. Products which are sent back to Kyriacos Photography will be shipped as standard parcels, and in scenarios where a replacement of a product has been agreed on, Kyriacos Photography will pay for any costs incurred for the replacement.

The onus of responsibility rests with you to maintain the state of the product as it was upon delivery. You cannot use the product, with the exception of viewing the product's state upon receiving it. While viewing the state of the product, if damages or defects occur the product is void of the opportunity to be returned under this policy.

Privacy Policy

It is known that with the acceptance of the Terms & Conditions the acknowledgment has been made and understood on cookies, personal data control, and this is consensual and aligned with the terms outlined in our Privacy Policy.

Price & Payment

The prices stated on the Website always apply to orders placed on the Website. All prices are presented in GBP and include VAT. The prices do not include payment- and shipping fees. These are given separately.

The Customer can pay for its purchase in any manner specified on the Website. Kyriacos Photography is entitled to charge the Customer in connection with the order. Kyriacos Photography also reserves the right not to offer all payment methods, at all times, and alternatively to change the payment method if the payment method the Customer has selected does not work. This is applicable for whatever reason, at the time of fulfillment of the order. Limitations of available payment methods are set forth on the Website.

Promotions & Contests

We may provide promotions and special offers on the web page for a limited period of time. Kyriacos Photography has the option to end any offers without notice. Upon termination of a promotion, these Terms & Conditions shall apply without any amendments. To participate in a contest you must be 18 years of age or over. Our employees can not participate in any competition. Winner are selected by us and the decision can not be appealed. Trading or exchanging prizes for alternative prizes, cash, or any monetarily valued items is not permitted, and any costs are to incurred by you which are not included within the winning of the prize itself. Should the originally stated prize offering become unavailable to us, an alternate prize of similar quality and value will be substituted and Kyriacos Photography has no liability for any financial implications the exchange of the prize may entail.

Products On The Web Page

We have no liability in case of products' visual or text misrepresentations, e.g. misrepresentation within descriptions or specifications, inaccurate prices or if products are sold out. We are entitled to rectify any such errors and to change or update the information at any time. Should inaccuracies in displaced product prices occur, we will notify you accordingly and await your approval of the amended price prior to us continuing with the order process. Force Majeure

Kyriacos Photography holds no liability for instances which may occur that are deemed outside reasonable control, which potentially can result in products being delivered outside the quoted time frame. This may include difficulties to procure raw materials and other difficulties, such as war, riots, labour conflicts, fires, floods, storms, accidents, power shortages, transportation shortages, and any type of interruptions as regards to Ahabi Imagery’s methods and or means of production.

Severability

If any provision of these Terms & Conditions are found invalid, such provision will be acted upon with due course in order to meet the necessary extent to eliminate its unenforceability or invalidation so that the balance of Kyriacos Photography’s Terms & Conditions remain in full force and effect.

Limitation Of Liability

The format and presentation of Kyriacos Photography’s website is "as is", and by using the website as presented, it is understood any risk in the process rests with you and is a reflection of your usage. Kyriacos Photography upholds the truest intent to display the products and format of the web page in a clear manner, notwithstanding that generally accepted internet disruptions may occur at anytime. Materials and information presented by the web user on the website are done so with an understood risk, and the actions of the user includes the responsibility of data loss which may occur. All attempts to withhold delivery of products are in the norms of standard services rendered, and should a delivery quote fail to be met, Kyriacos Photography has no obligation to refund a cancelled product. Any consequences which may affect financial consequences as a result of delivery quote times are not the responsibility of Kyriacos Photography.

Changes

We reserve the right to change these Terms & Conditions at any time.

Disputes

Disputes are to be resolved amidst you, the buyer, and Ahabi Imagery. The governance and jurisdiction within the United Kingdom are those upon which the Terms & Conditions are governed by, therefore the British laws are those which Ahabi Imagery shall adhere to.
